Dangerous situation caused by council

Bollards are being knocked over by cars on Princess Victoria Street, Clifton, and not being replaced by the council. 49, 53 and 55, relatively recently. My brother was nearly mown down by a car driving on the pavement, as he left the house. Residents expect not to be hit by cars. This has been raised before and the council do not think that knocked down bollards show that cars are driving on the pavement and pedestrians MUST be protected before a fatality occurs. Who should we sue then? The driver or the council for not taking action when asked?
