Public land being used as private carpark

By the side of the road is a lay-by and inside of that over the foot path is a grass verge ie public land. This has been used for parking by the near by residents - the grass area. At Issue here is that they have now started obstructing the foot paths.

Why is the council allowing public land to be used for the parking of select private residents. There are 3-4 cars parking hear on a permanent basis. At the very least the council should be seeking a rent for such usage.

Finally as for the cars they park permantaly in the layby the RAC states "Parking lights must be used on a road or layby on a highway with a speed limit higher than 30mph. " and sure enough they have no parking lights on.
