Tree roots growing into drain from house to pavement

Since 1999 when we bought 3 Hanbury Road tree roots have been growing from the road into the drain which runs from our house to the pavement. Twice we have had to claim on our buildings insurance for the drain to be relined. We have had a surveyor from Natwest inspect the property for a re-mortgage valuation. He expressed concern and recomended the front car port is dug up and the drain relaid in plastic. He also stated we should claim against Bristol Council for this damage caused by the trees.
