Location: Lowther Road – verge/footway adjacent to hedge (as shown in attached photograph) Issue type: Fly-tipping / dumped waste on public land Description I am reporting fly-tipped waste dumped on public land on Lowther Road, Brentry, as shown in the attached photograph. The item appears to be bulky dumped material, not incidental litter, and has been left on the verge adjacent to the footway. This is a pedestrian route used daily by residents. This report should be treated as fly-tipping, not routine litter, and removed accordingly. Statutory basis Environmental Protection Act 1990 – Section 33 Fly-tipping is a criminal offence. Environmental Protection Act 1990 – Section 89 The Council has a duty to keep relevant land clear of litter and refuse, including dumped items on highway land. DEFRA Code of Practice on Litter and Refuse Bulky dumped waste on public land must be removed promptly and not left pending routine cleansing schedules. What is requested Prompt removal of the dumped item. Confirmation it has been logged as fly-tipping, not litter.
